These terms and conditions apply to the services offered by The Eating Clinic for its Escape Emotional Eating online programme.

Prior to purchasing Escape Emotional Eating, please read these terms carefully. By purchasing Escape Emotional Eating programme, you agree to the terms and conditions set out below.

INFORMATION ABOUT US AND HOW TO CONTACT US

The Eating Clinic is a virtual clinic that provides nutritional, psychological and behavioural services. Based in Rochester Kent, we can be contacted using hello@theeatingclinic.com.

PROGRAMME OUTLINE

Escape Emotional Eating is an exclusive programme that is designed to help people address emotional eating and restore a balanced relationship with food. It is run over five weeks and provides one-hour live sessions each week. It is a group programme that is delivered online via Zoom.

GRANT OF LICENSE

In consideration of your payment, we hereby grant you a license to use the purchased Escape Emotional Eating programme (“the Product”). This license is limited, revocable, non-exclusive, non-transferable and is subject to the rights and obligations granted under these Terms.

The license is personal to you and cannot be exchanged or shared with others.

GENERAL

We develop, distribute, and maintain this Product. We will manage your access to the Product and provide support where necessary.

You shall not copy, modify, transmit, distribute or in any way exploit the Product or any other copyrighted materials provided other than for your individual learning. You shall not permit anyone else to copy, modify, transmit, distribute or in any way exploit the Product or any other copyrighted materials.

ACCESS TO MATERIALS

Access to materials will be provided for a five-week period starting from the date of the first session. The programme is open to individuals over the age of 18 years without an eating disorder. If you have a history of a diagnosed eating disorder, by purchasing the Product you agree that you have received consent to take part in the programme by your primary physician.

PRICING AND PAYMENT

We use Stripe (third party payment provider) to process our payments. Payment for the Product must be made at the point of purchase. We reserve the right to review and change the pricing of the product. This will not affect products that have already been purchased.

CANCELLATION AND RESTRICTION

In accordance with Distance Selling Regulations, you have the right to cancel and obtain a full refund within 14 working days from the date you enrol in the course. Should you wish to cancel, please request this in writing to hello@theeatingclinic.com and a full refund will be provided within 14 working days of receipt of any valid request.

In the event that one or more session has already taken place within the first 14 days following your enrolment, you are still entitled to request a refund but this will be provided deducting the value of the sessions that have taken place and along with any reasonable costs bourn by us in respect of the administrative costs of commencing the programme. The value of sessions will be determined pro-rata.

If you receive a refund, you agree to delete every copy of any materials provided by the programme. This includes downloaded copies as well as those held electronically.

It is your responsibly to ensure you meet the system requirements, including compatible hardware, software, telecommunications equipment, and Internet service, prior to purchasing the Product. We are unable to offer refunds due to insufficient system requirements.

LIMITATIONS OF LIABILITY

The Product is designed to support you to address emotional eating and restore a balanced relationship with food. You understand that the programme requires at least 2 hours per week for you to implement your learning (including a 1-hour live session per week).

This Product, The Eating Clinic or Emma Hendricks are not substitutes for the advice of your doctor or medical professional.

INTELLECTUAL PROPERTY

All rights, title and interest in intellectual property rights relating to the Product including copyright, patents, trademarks, trade secrets, improvements, developments, proprietary information, know-how, process, methods, and all other intellectual property (whether registered or not) developed or created from time to time shall exclusively be owned by The Eating Clinic. You understand there shall be no transfer of ownership by using the Product.

We act as a data controller for use of your personal data to provide you with access to this Product. We also act as a controller and processor in regard to the processing of your data from third parties. We act as a data controller and processor in regard to the processing of credit card and online payments.

We undertake at all times to protect your personal data, including any health and contact details, in a manner which is consistent with our duty of professional confidence and the requirements of the General Data Protection Regulation (GDPR) concerning data protection. We will also take reasonable security measures to protect your personal data storage.

We may use your personal data where there is an overriding public interest in using the information e.g. in order to safeguard an individual, or to prevent a serious crime. Also where there is a legal requirement such as a formal court order. We may use your data for marketing purposes such as newsletters but this would be subject to you giving us your express consent.
